Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Aussie End Helmet Hair Sweepstakes (the "Promotion") is open only to legal residents of the fifty (50) United States (including the District of Columbia) and Canada (excluding Quebec) who are at least eighteen (18) years old at the time of entry. Void in Quebec and where prohibited by law. Employees of The Procter & Gamble Distributing, LLC, its agencies, Resource Ventures, LLC, Marina Maher Communications, ePrize, LLC, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state, provincial, municipal, territorial and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's and Administrator's decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a contest (the "Contest") and a sweepstakes (the "Sweepstakes").

2. Sponsor: The Procter & Gamble Distributing, LLC, 1 Procter and Gamble Plaza, Cincinnati, OH 45202, U.S.A. Administrator: ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069, U.S.A.

3. Timing: The Promotion begins on July 1, 2008 at 12:00 a.m. Eastern Time ("ET"), ends on September 30, 2008 at 11:59 p.m. ET (the "Promotion Period") and consists of three (3) phases as set forth in the chart below:

4. How to Enter:

a. Contest: During the Submission Phase, visit Aussie: Soak up the moisture for radiant shine! and follow the links and instructions to upload one (1) photo demonstrating your worst case of helmet hair, and a fifteen (15) word or fewer description of your photo (the "Submission"). By completing the registration and uploading your Submission, you agree that your Submission conforms to the Photo Guidelines and Content Restrictions as defined below (collectively, the "Guidelines and Restrictions") and that Sponsor, in its sole discretion, may remove your Submission and disqualify you from the Contest if it believes, in its sole discretion, that your Submission fails to conform to the Guidelines and Restrictions.

Photo Guidelines:

The photo must be in .jpg, .gif and .png formats;
The photo must not exceed 4 MB in size; and
The photo cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.

Content Restrictions:

The Submission must not disparage Sponsor, its agencies, Administrator or any party associated with the administration of this Promotion;
The Submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
The Submission must not contain brand names or trademarks, except for the Aussie mark, for which entrant has a limited license to use for the purposes of entering a Submission into this Contest;
The Submission must not contain images or artwork not created by entrant;
The Submission must not contain material that is inappropriate, indecent, obscene, hateful, torturous, defamatory, slanderous or libelous;
The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state or province where the Submission is created.

For all Submissions: All Submissions will become the exclusive property of Sponsor, and none will be acknowledged or returned. Sponsor shall have the right to edit, adapt and publish any or all of the Submissions, and may use them in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity. ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES ENTRANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANSFERENCE TO SPONSOR OF ANY AND ALL RIGHT, TITLE AND INTEREST IN THE SUBMISSION INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. Sponsor is not responsible for lost, late, incomplete, invalid, un-intelligible or misdirected Submissions, which are disqualified. Limit: Each entrant may submit one (1) Submission during the Promotion Period.

b. Sweepstakes: During the Promotion Period, visit Aussie: Soak up the moisture for radiant shine! and follow the links and instructions to complete and submit the registration, including a valid home address. P.O. Boxes are not permitted. You automatically will receive one (1) entry into the Sweepstakes. Limit: You may enter one (1) time per day during the Promotion Period.

For Contest, Sweepstakes and Voting Phase: Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries or votes by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries or votes and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.

5. Winner Determination:

a. Contest: Contest winners will be selected according to the process set forth below:

i. Judging Phase: During the Judging Phase (see Section 3 for specific dates), qualified judges (the "Judges"), whose decisions as to the administration of this Contest and the selection of the finalists are final and binding in all matters, will select from all eligible Submissions received during the Submission Phase ten (10) finalist Submissions (the "Finalists"). Finalists will be selected according to the following criteria (the "Judging Criteria"):

33% relevance to Contest theme;
33% creativity; and
34% quality.

In the event of tie, the entrant whose Submission the Judges determine to demonstrate the highest relevance to the Contest Theme will be deemed the applicable Finalist.

ii. Voting Phase: During the Voting Phase (see Section 3 for specific dates), the Finalists will be posted in an online gallery for voting at Aussie: Soak up the moisture for radiant shine!. Individuals who meet the eligibility requirements set forth in Section 1 will be invited to vote for their favorite Submission. Limit: You may vote one (1) time per day during the Voting Phase. The four (4) Submissions that receive the highest number of votes during the Voting Phase will be the potential Grand Prize winners. The remaining six (6) Submissions will be the potential First Prize winners. In case of a tie, the Judges, in their sole discretion, will select the potential winner for the applicable prize from all tied Photos based on an application of the Judging Criteria.

b. Sweepstakes: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential Sweepstakes winners are final and binding in all matters related to the Sweepstakes. Administrator will randomly select the potential Sweepstakes Prize winners, from all eligible entries received during the Promotion Period, on or around October 6, 2008. The potential Sweepstakes winners will be notified by email or phone on or after October 6, 2008.

6. Winner Requirements: Except where prohibited, each potential Grand Prize winner (parent/legal guardian if a winner is a minor in his/her place of residence) will be required to sign and return to Administrator, within two (2) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability and Publicity Release (or Declaration of Compliance, if Canadian resident) in order to claim his/her prize. If a potential winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release (or Declaration of Compliance) within the required time period (if applicable), potential winner forfeits prize. If a Canadian resident, a potential Sweepstakes winner will be required to correctly answer a time-limited, skill testing question without any assistance in order to be eligible to receive a prize. If a potential winner is a Canadian resident and the question is answered incorrectly, the prize will be forfeited. In the event that a potential winner of any prize is disqualified for any reason, Administrator will award the applicable prize to the person whose Submission received the next highest number of votes during the Voting Phase and/or received the next highest score via an application of the Judging Criteria (if for Contest Prize) or to an alternate winner by random drawing from all remaining eligible entries (if for Sweepstakes Prize). Only three (3) alternate drawings will be held, after which the applicable prize will remain un-awarded. For U.S. residents, prizes will be fulfilled eight (8) to ten (10) weeks after the conclusion of the Promotion. For Canadian residents, prizes will be fulfilled the latter of eight (8) to ten (10) weeks after the conclusion of the Promotion or two (2) to three (3) weeks after receipt of the skill testing question.

7. Prize:

a. Contest Prizes:

FOUR (4) GRAND PRIZES: A trip to New York, New York for a makeover with Aussie Celebrity Stylist Sarah Potempa. Trip package includes roundtrip, coach-class air transportation (up to $1200 USD if U.S. winner and up to $1500 USD if Canadian winner, plus up to $360 USD in ticketing/travel fees) for one (1) from a major airport near winner’s home (determined by Sponsor in its sole discretion) to New York, New York; two (2) nights accommodations at a hotel of Sponsor's choice (up to $1000 USD for a single room, double occupancy) and $400 USD in spending money; a consultation and styling with Sarah Potempa; a one (1) year supply of Aussie Opposites Attract Collection shampoo ($60 USD); a photo shoot for possible use in U.S. publications (photo shoot opportunity carries no cash value and is subject to cancellation at Sponsor's sole discretion. Publications determined by Sponsor in its sole discretion.); and one (1) $250 USD Old Navy® Appreciation Card (Terms and conditions of gift card apply). For Travel: Sponsor will determine travel itinerary in its sole discretion. Trip subject to availability, blackout dates and availability/schedule of Sarah Potempa. Travel must be roundtrip. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Promotion, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. If a Canadian resident, winner is solely responsible for obtaining valid passports and any other documents necessary for international travel. Travel restrictions, conditions and limitations may apply. If, in the judgment of Sponsor, air travel is not required due to winner's proximity to prize location, then ground transportation will be substituted for roundtrip air travel at Sponsor's sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor is not responsible if makeover with Sarah Potempa is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor's sole discretion. Approximate Retail Value ("ARV"): $3,270 USD. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value.

SIX (6) FIRST PRIZES: A one (1) year supply of Aussie Opposites Attract Collection shampoo ($60 USD) and a digital camera ($150 USD). Make, model and features of digital camera to be determined by Sponsor in its sole discretion. ARV: $210 USD.

For All Contest Prizes: Limit: One (1) Contest Prize per person.

b. Sweepstakes Prizes:

TEN (10) SECOND PRIZES: A one (1) year supply of Aussie Opposites Attract Collection shampoo ($60 USD) and an iPod® Shuffle ($70 USD)*. ARV: $130 USD.

*iPod® Shuffle is a trademark of Apple Inc., registered in the U.S. and other countries. Apple iPod® Shuffle is being used for prize description purposes only and Apple, Inc. is not affiliated or sponsoring the Promotion nor are they involved in the administration of the Promotion.

TWENTY (20) THIRD PRIZES: A one (1) year supply of Aussie Opposites Attract Collection shampoo ($60 USD) and a $50 USD Old Navy® Appreciation Card. Terms and conditions of gift card apply. ARV: $110 USD.

For All Sweepstakes Prizes: Limit: One (1) Sweepstakes Prize per person. Odds of winning a Sweepstakes Prize depend on the number of eligible entries received during the Promotion Period. Total ARV of all Sweepstakes Prizes: $3,500 USD.

For One (1) Year Supply of Opposites Attract Collection: Prize will be awarded in the form of twenty (20) bottles including five (5) 13.5 fl oz (400ml) bottles of shampoo, five (5) 13.5 fl oz (400ml) bottles of conditioner, five (5) 10.2 fl oz (236ml) bottles of non-aerosol hairspray and five (5) 6 oz (170g) bottles of mousse. ARV of each bottle: $3.99 CDN/$2.99 USD. For Electronic Prizes: The ARV is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed.

For All Prizes: Each prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Each winner is responsible for all taxes and fees associated with prize receipt and/or use.

8. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, its agencies, Resource Ventures, LLC, Marina Maher Communications, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.

9. Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor's and its agents' use of winner's name, likeness, photograph, voice, opinions and/or hometown and state or province for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. For Sweepstakes: If, for any reason, an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. For Contest: Sponsor is not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor and Administrator are not responsible for any typographical/other error in Submissions, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest.

12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Michigan, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan, U.S.A.

13. Entrant's Personal Information: Information collected from entrants is subject to ePrize's Privacy Policy (ePrize, LLC. Privacy Policy) and Sponsor's Privacy Policy (Procter & Gamble Privacy Notice).

14. Winner List: Winner List requests will only be accepted after the promotion end date (listed above) and no later than February 2, 2009. For the Winner List, send an email with subject line: "M - Aussie End Helmet Hair Sweepstakes, Winner List Request," to WinListRequests@eprizefulfillment.com.
