I will try to keep this as short as possible. Here is the story.
My DH's ex is up to her evil ways again. She is taking him back to court for child support. Don't get me wrong he has no trouble with paying child support. It is just that he has been railroaded ever since his divorce. (which he left her everything)
She runs a daycare out of her home that her and DH used to share. She has since moved in with her BF and rents out the house with the daycare. The problem is she is still claiming she resides at the old address. I know this for fact because it is on the summons.Truth be known she hasn't reported this income to the IRS either. There is so much more to this story and if you need more details let me know. Now for my question....how do I find out her new address short of hiring a private investigator?
I might also add she lives 14 hours from me. And yes, I thought about driving there and following her.

I would think that the court would compel her to share her address with the father of her child(ren). Do you have the boyfriend's name? If so, google it along with the name of the town and see what comes up (like this: John Doe + City Name).

DH definitely knows I am trying to find this information. I seem to have better luck finding things on the computer. LOL Unfortunately we don't know the BF's name. She instructed his kids not to give the address. All they were allowed to give him was the town. As for the court compelling her to give this information... I don't know. One time they asked her what her income was for the year and as far as I know she didn't have to show proof. Meanwhile DH had to mail copies of tax papers and everything else. I just checked the site and it has her old address listed. I seriously doubt that she has changed anything with her new address including her drivers license. She still runs the daycare out of the old residence so her mail still probably goes there.

Ok yes, it matters if the boyfriend treats the kids bad, the house is uninhabitable etc.

But other than that, it shouldn't matter where she is living unless she is not giving him the proper address to pick up the kids for visitations.

When I go into domestics (ex has drug me in several times lately trying to get his payments reduced) my lawyer has a laundry list of documents I have to have (paystubs, w2, proof of insurance). They also send out paperwork for my employer to fill out regarding my income, hours I work, etc.

It doesn't matter where I live, how much I pay in rent, or if my boyfriend lives with me.

Tread lightly. You start hiring people to follow her or follow her yourself you'll be lucky if she doesn't use that against your husband (they're stalking me, intruding on my life, relationship with the kids, etc).

One of his kids doesn't even live with her. He has a job and his own apartment. I could care less where she lives or who she lives with. My point is she is using the old address for the courts and everything else while she rents that house out and lives with her BF. So since she is using the old address she is not reporting the rent she receives as income. As far as visitation she is suppose to meet half way. She has never done this. It was DH going there or a couple times his son's friends brought him here. And he had to include my salary on the form he had to fill out in the past. So I am sure the courts are different in different states. I could write a page on this but as I said in my first post I was trying to keep it short. It just really frustrates me that she gets by with as much as she does.

as to getting the bf's addy, as long as you know the name or known alias(es) the bf uses, try looking on online white pages, zabasearch or intellius people for free.

as to her renting out the house she shared with your DH, I don't know if it is illegal to use that address when she rents it out because technically, she still owns it. on the non report of rental income, if you have enough proof, check this for the IRS guidelines on whistleblowers. Once the IRS takes her case, you may step back

I'm not sure any of this matters if she isn't on the lease with her bf or have a lease from him. If she owns the other house, her mail goes there, and her license states that's where she lives, then as far as I know the courts will view that as her residence. All she would have to tell the courts is that she stays over at her bf's sometimes as to why she is there so much.

As far as renting out the property, if you bring it up in court the burden of proof is on your husband. If he has no proof that she is renting it out, and he brings it up in court it could make him look bad. And if she is renting the property out and just getting cash, she likely doesn't have a lease and no proof she is renting it. Her not having a lease might just screw her over in the end though.

I would speak with an attorney on this. I have been through 3 custody cases. I'm in court every couple months with one of my kids' dads for custody, child support, or whatever else, and without proof of anything, it just hurts you. It's amazing what people get away with!

how do you know she is renting the house? is there a way you could prove it? any bills in the renters name? maybe you could get some pic's of the renters. just because you prove she doesn't live there doesn't prove she is renting. you need to find a way to prove she is renting.

As for your situation, the only thing I can think of is to bring it up in court.

If you don't know the bf's name, it will be difficult to trace his address so the first thing you have to find out is the bf's name. You're right, you may need a private eye to do this. But question is, are you willing to go that far? I suggest you sit down with your DH and discuss this and know exactly what both of you are comfortable in doing. Hiring a private eye NOT only entails $$ OOP but their child support case may also be affected in her favor if she files a case of stalking against you and your DH. I hope that when your DH talked to the lawyer, he mentioned about her "allegedly" living in with the BF and if that is enough proof that she abandoned the original residence.

I'm not a lawyer but based on what you've said, you need concrete proofs here, not just hearsay to prove your case in court. To get those proof, you may have to shell out $$, and depending on how far you want to go, you may be out of substantial money. I understand she may be manipulative and cunning, but the more you should be on guard because one who does these kind of things are likely more knowledgeable than you on how to cover their backs and likely not get caught. Concrete proof is vital in your case since that is what the courts will base their decision.

Yes he has discussed all this with a lawyer. The lawyer mentioned a PI. So I guess it will depend on how much $ is involved with one as to how far he will go. She gets coached in her evil ways as she could not come up with some of the things she is pulling. We know a few things but I doubt it would be could to mention them on the internet. You never know who is watching. LOL

On a side note, I just visited that spokeo website, and to my surprise all my information and my family's information was readily available. In the passed, I believe that I was being followed. That website is terrifying.

It does have my correct street which is public records and anyone can get. Also we are still listed in the phone book, so that is no secret.

I see my father in law as part of the family tree. He is listed as being in his 40's .

If this is the type of information people are getting and paying for what a joke!!

Not to get too off topic but while some info may not be correct from personal experience A LOT can be. It had my families phone numbers and email addresses accurate. There is a link on the spokeo help section that tells you how to remove your listing. For those that have accurate info I would suggest removing it. Even though there are other sites that that info can be found on.

It is very scary how much information you can get online. If you Google me, you only find content that I want you to find. Once you know how to manage search engine results, it's very easy. I use a PO box so my physical address is no where to be found and the only phone number you will find is a virtual number that has a voicemail box on it. The only social networking I use is Twitter and it's a protected account so you can't find me via those sites either. People think it's suspicious that I'm a very private person but I don't want that information out there and once you give it out, it's out. I had to have my phone number changed way too many times to give it out now. I just give out the virtual number and return calls from a blocked number. Only my immediate family and close friends have my real phone number.

You really can't trust anyone! My mom never even used a computer much other than youtube and such and her identify was stolen last year. I still haven't straightened out the mess whomever stole it created with the IRS. My mom was killed in a car accident in March and we still haven't got her tax refund. It's just listed as "processing" because the identity thieves filed for her and we had to send in a paper return. I'm afraid to call and ask about it as they might not send it at all then.
