I got a phone call from my attorney today and him and I were both surprised.
One of the companies i am suing for harassment is counter suing me.
This has been going on for almost a year, and we were scheduled to go to court in February.
Out of the blue my attorney gets an email saying that this company has dropped the counter suit and is releasing me from any debt to them, and also is paying my attorney fees in full $6600 and the icing on the cake was when he told me that they are paying me $1000, which is the max that i can receive from this type of lawsuit.
Talk about speechless, I really didn't want to go to court and now I don't have to.
Not many things can make me speechless but this actually did for a few seconds.
Sorry for this being so long, but had to share.
1 more thing, I received 2 of my rebate checks from SC Johnson today for the glade candles.

Wish it would show up before Christmas but I am not going to count my chickens before they hatch. Just knowing that they have dropped the suit and that They have realized how they broke the law is good enough for me.
My holiday weekend is going to be so much more fun.
It feels like there has been a gray cloud lift off my head and can breath again

See i tried to settle this account by making $25 monthly payments, well they said no and they said that they could not hold onto my account that long.
Well the funny thing is, if they had just accepted this amount, we would have been done.
Now instead of them making money on me, it ended up costing them not only the money I owed them, it also cost them $6600 for my attorney, also an additional $1000 to me.

I took a while.
In the last year we had a lot of financial problems, and I found this attorney who will turn the tables on bill collectors, and it is all legal. At first I thought yeah right ok I will not get anything and still have to pay the debt. But wow this attorney has really looked out for me.
I have settled 2 cases so far and with this company that makes 3.
Still have 6 more to go.

See a lot of bill collectors think that we don't know the law, and when they call I tell them that they are breaking the law, they laugh at me and tell me yeah right.
Well I am turning the tables on them, and boy they learn a lesson the hard way.

With me winning these cases, maybe we will not have to file for Bankruptcy. I can take the money as I get it and work out deals with the actual companies.

I'm pretty sure you will have to pay taxes on that amount as income. Since you owed the money and you didn't pay it, it is a source of income. I'm not sure how much debt you had, but just remember that when you do your taxes. Your attorney will know also.

Yeah I will have to pay taxes on it, every time a case settles, I have to sign and fill out a w-9 which is a tax form.

i was about to ask that too. I have a reletive who is up to her ears in issue with CC companies and is "trying" but cant make any of them happy EVER.
Im not there yet but its always something i worryabout

I live in California so the laws do very from state to state, by California law any bill collector can not call more than 1 time per day, they can not leave an amount that you owe on your answer machine, voice mail, or even leave a message with someone.
They can only call between the time of 8 am and 9 pm monday through saturday, and 9 am and 5 pm on sunday.
I know there are more laws, but I can remember what they were.
You can do a Google search and look under the Federal Debt Consumer Privacy Act.
I remember another one, they can not talk to a 3rd party and discuss your account with them.

I agree. Taxes on an additional $7600 plus the amount of debt written off really sucks -- especially when that additional "income" (although you never really see any of it) could put you into the next higher tax bracket and subject your entire income to higher taxes.

Although it's a high five time for the slapping down the collection agency took, it's also a quick dowsing of cold water on the face of reality for the hand out that Uncle Sam has in these situations.
